A witness for PC maker Gateway Inc. testifying today was sharply critical of Microsoft Corp.'s new "uniform" licensing terms as a way for the company to gain "additional control over Gateway in the guise of a remedy." The terms are part of the Bush administration's proposed settlement in the case.
in the story here (http://www.idg.net/ic_835692_1794_9-10000.html), Fama (Gateway's general counsel) describes how new microsoft terms will put them at a disadvantage. for starters even if they don't sell a pc with an operating system, they will still have to pay royalty to microsoft. It also states the pricing scheme that would give the really large companies (dell) a break.
there is more in the article, just seems that when you think that microsoft is coming clean that they have an ace up there sleeve.

hmm getting interesting
A Microsoft attorney on Tuesday worked to discredit testimony by a Gateway executive, saying he was biased because AOL Time Warner holds a large chunk of the computer maker's stock
I found this (http://news.com.com/2100-1001-869025.html) on cnet today. I still don't belive microsoft though. Seems like they are grasping at straws

Neither one of those companies got to where they are at by being passive, this could be an interesting story to keep an eye on. I'm sure that's not the whole story, but I would be ticked off if I had to pay a developer for not including their software.
